Burn Injuries at work entitle you to medical treatment and many other benefits. Those benefits include temporary and permamant disability payments, depending on the sevarity of your injury. In July of 2017, the Oklahoma Medical Research Foundation (OMRF) began a partnership with the GlaxoSmithKline (GSK) drug development company. This partnership is focusing on creating an antibody that fights release of histones. Histones are proteins that enter the bloodstream and kill the lining of blood vessels resulting in uncontrollable bleeding. Histones release during major trauma, like burn injuries. While these are significant advances in treating burn injuries, the medical expenses are still outrageous. Further, burn injuries usually requires several weeks of hospitalization or treatment and weeks off of work.
Burn Injuries and Oklahoma Law
Burn injuries are one of the compensable injuries under Workers’ Compensation laws. However, it must meet certain requirements in order to be compensable. These include:
– Your status must be an employee
– You must receive an injury (in this case a burn injury)
– The injury must occur while you are working or performing some kind of work-related duty
– The duty must be part of your regular job or a special task your employer assigns to you
– Your injury must make you unable to work or make you lose wages in some manner.
As you can see, your injury must occur while you are legitimately working. If you receive an injury doing something against workplace policy, it is unlikely you will be able to receive any type of Workers’ Compensation. However, if you are working in your normal capacity (such as a cook in a restaurant kitchen) then you can expect to have a workers’ compensation claim.
